WHAT TO EXPECT AT MEDIATION

The goal of your mediation is to work out a resolution, which all participants find acceptable.  For each case, two trained mediators will meet together with participants.  The mediators will lay out the ground rules for the meeting, but they will not tell you how to resolve your problems.  That will be up to participants.

The mediation will begin with each participant allotted UNINTERRUPTED time to talk about the problem as they see it.  Then there will be an open discussion, when all participants and the mediators will identify each of the problems and work on them – one by one.  If you reach an agreement, the mediators will write the agreement and you will have a signed copy.  A copy will remain on file in our office.


EVERYTHING THAT HAPPENS IN MEDIATION IS CONFIDENTIAL
.  The only exception is suspected child or elder abuse or neglect, or threats to do bodily harm to oneself or another.  Parties outside the dispute are discouraged from attending and are allowed only with the permission of all participants.

Mediation usually takes two hours.  If more time is needed, you and the mediators can schedule a second session at everyone’s convenience.  A date and time for the follow-up mediation should be arranged at the end of the first mediation to ease scheduling.

The mediation will not take place if any participant appears to be impaired by alcohol or drug use.  For the consideration of all parties, try to avoid canceling mediation.  If cancellation cannot be avoided, please call our office as soon as possible and suggest a time and date to reschedule.
